Please retain a copy of this agreement for your records.The content, tools, and services made available to customers and third-party vendors on greatsolardeals.com, including all pages hosted under this domain (referred to as the “Site”), are managed and operated by Great Solar Deals, Inc., a Delaware corporation (“Great Solar Deals”). These Terms of Use (“TOU”) define your obligations when utilizing the Site, accessing its resources, or using the Services as described in Section III, “Description of Services; Limitations on Services.” We strongly advise you to read these TOU carefully before proceeding. Additionally, we encourage you to familiarize yourself with Great Solar Deals' Privacy Policy (refer to Section XI, “Privacy Policy”), which explains our dedication to protecting user privacy.
I. Acceptance of Terms
Within these TOU, the terms "you" and "User" apply to all visitors to the Site and users of the Services (as outlined in Section III, “Description of Services; Limitations on Services”), including employees of Third-Party Vendors accessing the Site on behalf of their employer or for personal use.
By accessing the Site or utilizing its Services, you confirm your agreement to abide by these TOU. Furthermore, whether you access the resources or Services directly on the Site or through alternative methods (such as phone, email, or mail), you agree to follow these TOU as well as any applicable posted guidelines. Great Solar Deals reserves the right to modify these TOU or associated guidelines at any time without prior notice. (See Part II, “Modifications to This Agreement.”)
If you disagree with any part of these TOU, any associated guidelines, or future updates to them, your sole remedy is to discontinue your use of the Site and Services immediately. Great Solar Deals reserves the right, but is not obligated, to enforce compliance with these TOU and posted guidelines through any means, including legal action or self-help remedies.
By using this Site or any of the resources or Services it offers, you acknowledge that you are bound by these TOU in their entirety. If you do not accept these terms and conditions, you are not authorized to access the Site or use its Services. Great Solar Deals' acceptance of your use is explicitly conditional on your agreement to these TOU, to the exclusion of any alternative terms. If these TOU are considered an offer, Great Solar Deals' acceptance is strictly limited to the terms outlined herein.
II. Modifications to This Agreement
Great Solar Deals retains the right to amend, modify, or update these TOU at its discretion and without prior notice. Such changes will take effect immediately upon being posted to the Site. These TOU constitute a binding agreement between you and Great Solar Deals, and it is your responsibility to regularly review them to stay informed of any updates. The latest version of the TOU is always available via the “Terms of Use” link located at the bottom of the Site.
III. Description of Services; Limitations on Services
Great Solar Deals offers various tools, services, and resources (collectively referred to as the “Services”), which are detailed more fully on the Site. These offerings may include, but are not limited to:
Calculators, estimators, proposal systems, and visual data tools for assessing energy and financial performance.
Dashboards, self-evaluation guides, maps, summaries, digests, member forums, and blogs.
Information about third-party vendors, such as contractors, manufacturers, lenders, and financial institutions (“Third-Party Vendors”).
Product or service descriptions and related materials provided by Third-Party Vendors, either via the Site, the Services, or directly to the User in response to a Submitted Request (as defined in Section IV, “Requests for Information and Services”).
The materials you access or use—whether through text, user comments, data, graphics, articles, photos, audio or video clips, brochures, illustrations, or software (collectively referred to as “Content”)—are subject to these TOU. Great Solar Deals reserves the right to modify, limit, suspend, or discontinue any Services or Content at any time and without notice. Access to certain features or portions of the Services may also be restricted at the company’s discretion.
Unless explicitly specified in writing, no material on the Site constitutes a guarantee or commitment to deliver any products or services by Great Solar Deals or any Third-Party Vendor. Additionally, Third-Party Vendors may not offer all products or services listed on the Site in all locations or jurisdictions, and eligibility may depend on criteria outside the control of Great Solar Deals
IV. Requests for Information and Services
You may request Great Solar Deals or any Third-Party Vendor to share information about specific products or services, or to submit proposals for offering those products or services (referred to as a "Submitted Request"). By submitting a request to Great Solar Deals or a Third-Party Vendor, you authorize them, as applicable, to communicate with you through the contact methods provided, including via the Site, phone (if your number is included), email, mail, facsimile, or any other form of communication. When you provide your phone number as part of your Submitted Request, it signifies your explicit written consent for Great Solar Deals or its Third-Party Vendors to contact you via phone, even if your number is listed in any state or federal Do Not Call database. However, phone contact will only occur if:
You include your phone number as part of the Submitted Request, and
You specifically request phone communication or agree to a proposal from a Third-Party Vendor.
V. Registration Requirements
To access certain features and Services, you must register with Great Solar Deals and provide a valid email address during the registration process. Upon registration, Great Solar Deals will assign you a unique screen name, referred to as a “User ID,” based on the email provided. You can update this User ID at any time. Additionally, you are required to submit accurate, complete, and current information during the registration process. Failure to meet these criteria will constitute a breach of the TOU and could result in the suspension or termination of your account with Great Solar Deals.
You are prohibited from:
Using someone else’s name as your User ID with the intent of impersonating them.
Selecting or using a name you are not legally permitted to use.
Creating a User ID that is offensive, obscene, vulgar, or otherwise inappropriate.
Great Solar Deals reserves the right to refuse registration or cancel any User ID at its sole discretion. You are solely responsible for safeguarding your User ID and password to ensure their confidentiality.
VI. User-Provided Content
Registered users of the Site may upload or share content such as messages, text, files, images, videos, audio, or other materials (collectively, "User-Provided Content"). The individual or Third-Party Vendor who creates and shares such content bears full responsibility for it. By posting or transmitting User-Provided Content via the Site or Services, you accept full accountability for ensuring the accuracy and appropriateness of the material.
Great Solar Deals does not control or verify User-Provided Content and acknowledges that such content may sometimes be inaccurate, incomplete, subjective, or misleading. Furthermore, User-Provided Content may include links to external websites not affiliated with Great Solar Deals. Great Solar Deals does not endorse or guarantee the accuracy of information hosted on these external sites. Visiting such websites is done at your own risk, and any information (including personal information) collected by these sites is governed by their privacy policies, not by Great Solar Deals' Privacy Policy. Users are strongly encouraged to review third-party privacy policies before engaging with those websites.
As a user, you agree to independently evaluate any User-Provided Content and accept all risks associated with it. Under no circumstances will Great Solar Deals be held liable for losses or damages resulting from reliance on or use of User-Provided Content. Great Solar Deals does not pre-screen User-Provided Content for accuracy or reliability and does not endorse any User-Provided Content. The company retains the right, but is not obligated, to remove, relocate, or reject User-Provided Content that violates the TOU or for any other reason it deems appropriate.
Opinions shared by Users or Great Solar Deals concerning energy products, services, or financial offerings on the Site or through the Services are considered User-Provided Content. Great Solar Deals disclaims responsibility for the accuracy or completeness of these opinions and will not be liable for any loss or damage arising from reliance on such statements.
VII. Rights to User-Provided Content
By submitting User-Provided Content through the Site or Services, you grant Great Solar Deals, its affiliates, representatives, and designated partners a non-exclusive, worldwide, royalty-free license to display, distribute, publicly perform, store, transcode, broadcast, reproduce, modify, adapt, create derivative works, and otherwise utilize the content in any format or medium for any purpose. You acknowledge that there is no expectation of compensation or confidentiality regarding the User-Provided Content you share, and it will be accessible to all users of the Site and Services. Great Solar Deals reserves the right to edit, remove, or reject any User-Provided Content at its sole discretion.
By submitting User-Provided Content, you warrant that:
You own all the rights to the content or have secured the necessary permissions to grant Great Solar Deals the rights specified here.
You have settled any fees or obligations tied to licensing or legal permissions for the content.
If the content includes individuals, you have obtained proper consent from all depicted or recorded persons (including legal consent for minors).
Any renewable energy systems featured in the content are located on your property, or you have permission to share content related to them. Third-Party Vendors sharing similar content must have the consent of the property owner.
You will provide documentation to verify the above claims upon request from Great Solar Deals.
The content does not infringe upon any third-party intellectual property, privacy, publicity, or other legal rights.
You further agree to maintain records proving compliance with these warranties and to provide such records to Great Solar Deals upon request.
VIII. Digital Millennium Copyright Act Compliance; Designated Agent
Great Solar Deals values and respects the intellectual property rights of others. If proper notice is received, Great Solar Deals will promptly remove User-Provided Content that infringes copyright laws and may also terminate accounts of repeat offenders. If you believe that any material hosted by Great Solar Deals violates your copyright, you are encouraged to provide the necessary details. Upon receipt, Great Solar Deals will take appropriate action to remove the copyrighted content from the Site or Services.
IX. Third-Party Content and Websites; Third-Party Transactions and Services
The Site may include materials, features, or tools that link to or enable access to external content and resources provided by third parties, including Third-Party Vendors. This third-party content may consist of websites, applications, software, directories, databases, networks, products, or services entirely independent of Great Solar Deals. Great Solar Deals makes no guarantees about the accuracy, completeness, or authenticity of any such third-party information and accepts no liability for losses or damages resulting from reliance on or use of such content.
Great Solar Deals operates as a resource for individuals and businesses exploring the costs and advantages of distributed energy systems. The Site connects users with Third-Party Vendors, such as system manufacturers, installers, and financial providers, allowing users to request project proposals, cost estimates, and additional information (refer to Section IV, "Requests for Information and Services"). Great Solar Deals may receive compensation from vendors for facilitating these connections (“Opportunities”) but does not charge users to access its Site or Services. It is not itself a manufacturer, installer, contractor, distributor, or broker of energy-related systems or services.
Great Solar Deals is not authorized, and explicitly declines any offers of authorization, to act as an agent for manufacturers, contractors, installers, or financiers, except for its role in generating Opportunities as described above.
If a user wants Great Solar Deals to provide consulting services or act as their agent for a fee, such authorization must be explicitly provided in writing. Without this written agreement, users should not assume or infer such responsibilities from Great Solar Deals.
Occasionally, Great Solar Deals collaborates with businesses, non-profits, government entities, or employers ("Channel Partners") to extend its Services to their members, customers, or employees as described in Section III, "Description of Services; Limitations on Services."
Any engagement or transaction you enter into with an organization, vendor, or Channel Partner through the Site or Services, including payments for goods or services, is solely between you and that entity. It is your responsibility to investigate and verify any terms, warranties, or representations before proceeding. Great Solar Deals is not liable for losses or damages arising from such transactions.
If a dispute arises between you and another User, a Channel Partner, or a Third-Party Vendor, Great Solar Deals has no obligation to mediate or resolve the matter. By using the Site, you release Great Solar Deals, its employees, agents, and affiliates from all claims, known or unknown, arising from such disputes. California residents explicitly waive California Civil Code 1542, which states: “[a] general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.” This waiver also applies to similar laws in other jurisdictions.
X. Conduct
You agree to use the Site and Services lawfully and responsibly, refraining from any actions prohibited by these TOU or that interfere with the enjoyment of the Site or Services by others.
Prohibited behaviors include, but are not limited to:
Uploading or sharing content designed to harass, threaten, or impersonate others.
Posting material that is offensive, defamatory, or irrelevant to the Site’s purpose.
Attempting to access or misuse another User’s account or Personal Information (as defined in Section XI).
Violating the intellectual property rights, privacy, or other legal rights of any individual or organization.
The above examples represent some, but not all, unacceptable activities on the Site.
Unless specifically allowed through authorized features like RSS feeds, you may not use automated tools or methods to access the Site or its Services without prior written approval from Great Solar Deals.
Additionally, you are prohibited from:
Advertising or soliciting other Users to purchase or sell products or services without explicit authorization from Great Solar Deals.
Using any information obtained from the Site to contact, solicit, or market to other Users without their explicit consent.
Operating on behalf of or at the request of third parties without express approval.
Selling or transferring your Site profile or User ID to another party.
Great Solar Deals may, at its sole discretion, remove content or deactivate User accounts without prior notice, whether due to reported violations or for other reasons. If you encounter or wish to report a breach of these TOU, you can contact [email protected].
While Great Solar Deals reserves the right to monitor disputes between Users, Channel Partners, or Third-Party Vendors, it has no obligation to intervene or resolve such conflicts. You remain fully responsible for your interactions and transactions with other Site Users, Channel Partners, and Vendors.
XI. Privacy Policy
Refer to Great Solar Deals’ Privacy Policy to understand the types of data we collect, including information that identifies or contacts you personally (“Personal Information”). The Privacy Policy explains how we use, store, and protect this information, as well as circumstances under which it may be disclosed or transferred. It also outlines your options for submitting and managing the information you provide. We strongly encourage you to review the Privacy Policy to familiarize yourself with our practices. The latest version of the Privacy Policy is accessible through the "Privacy Policy" link at the bottom of each page on the Site.
XII. Copyright and Trademark
All materials on the Site are Copyright © 2023 Great Solar Deals, Inc. and/or its Third-Party Vendors, with all rights reserved. Other product and company names mentioned on the Site or in the Services may be the trademarks of their respective owners.
The Site and Services contain copyrighted content and proprietary materials, including but not limited to text, software, photos, videos, graphics, music, and sound. The entirety of the Site and Services constitutes a collective work under U.S. copyright laws. Great Solar Deals owns copyrights for the selection, coordination, arrangement, and enhancement of such content. Users may not modify, publish, sell, create derivative works, or otherwise exploit the content, in part or in whole, without explicit permission from Great Solar Deals and the copyright holder. Certain elements of the Site and Services may also be protected by trade dress, patents (including pending patents), or other laws and may not be copied or mimicked by any means, including framing or mirroring.
XIII. Disclaimers and Liability
Great Solar Deals strives to provide accurate and reliable information on the Site and through its Services. However, errors can occur, and information may be updated or revised at any time. Under no circumstances will Great Solar Deals be held liable for damages or losses resulting from reliance on Site information or Services. Users must independently evaluate the accuracy, completeness, or usefulness of any opinions, advice, or content available on the Site or Services.
The Site, Services, and associated information, software, products, and materials are provided “as is.” Great Solar Deals, its affiliates, suppliers, and service providers disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a specific purpose, title, and noninfringement. Use of the Site and Services is at your own risk.
Great Solar Deals and its affiliates, suppliers, and providers are not liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of or related to:
Your inability to use the Site or Services, including delays, errors, or unauthorized access.
Errors, omissions, or interruptions in the Site or Services, or defects like viruses, worms, or harmful software.
Reliance on any information, software, or materials provided via the Site or Services.
Some jurisdictions do not allow the exclusion of certain warranties, so portions of this disclaimer may not apply to you.
XIV. Indemnity
By using the Site or Services, you agree to indemnify and hold harmless Great Solar Deals and its Third-Party Vendors from any claims, liabilities, or expenses, including legal fees, arising out of your use of the Site or Services. This includes claims asserting that your actions constitute a breach of these TOU.
XV. Errors and Delays
Great Solar Deals is not responsible for errors or delays caused by factors beyond its control, including but not limited to inaccurate information provided by users (e.g., an incorrect email address) or technical issues. Additionally, Great Solar Deals is not liable for errors or delays in processing requests submitted to third parties, including Third-Party Vendors.
XVI. Dispute Resolution
Any claim or controversy arising out of or relating to the use of the Site or the Services, to any goods or services provided by Great Solar Deals, or to any acts or omissions for which you may contend Great Solar Deals is liable, including but not limited to disputes over arbitrability ("Dispute"), will be exclusively resolved by binding arbitration. The arbitration will be conducted before one arbitrator in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA") in effect at the time. The venue for any arbitration will be located in Texas, unless both parties agree to an alternate location within Texas.
The arbitrator will be selected according to the AAA rules. If no AAA rule governs the selection process, the parties will agree on an arbitrator, or, failing agreement, the selection will be made by the AAA. In arbitration, Great Solar Deals will cover the filing fees and costs associated with the first day of arbitration. Any remaining arbitration costs will be borne by the non-prevailing party.
Judgments based on arbitration awards may be entered in any court of competent jurisdiction in Texas. The arbitrator will not have the authority to award punitive, consequential, or exemplary damages and is limited to granting compensatory damages only. Both parties waive any claims to such non-compensatory damages. Furthermore, no arbitration under these Terms will be consolidated with disputes involving other parties without the consent of all involved.
This arbitration agreement means you waive your right to litigate disputes in court, including participating in or bringing class action lawsuits. Your rights will instead be decided by a neutral arbitrator, and the process is designed to be simpler and more limited than court proceedings. Arbitrator decisions will be binding and enforceable as court judgments, subject to limited judicial review.
If for any reason the arbitration provisions become unenforceable or do not apply, or if a lawsuit arises between you and Great Solar Deals, the parties agree that jurisdiction and venue will exclusively reside in the state and federal courts located in Texas. In any legal action, the prevailing party will be entitled to recover reasonable attorneys' fees and associated costs.
XVII. Other Terms
This Agreement, along with any additional provisions related to the use of the Site and Services (including any supplemental terms for specific content or services), constitutes the complete agreement between you and Great Solar Deals. It replaces any prior agreements, whether oral, written, or electronic, related to the Site, the Services, and any associated information, software, products, or content.
This Agreement is governed by the laws of the State of Texas, excluding its conflict of laws principles. If any provision is deemed unenforceable under applicable law, the invalid portion will be replaced with a valid provision that closely matches the intent, and the rest of the Agreement will remain in effect. A printed copy of this Agreement or any electronically provided notices will be admissible in legal or administrative proceedings to the same extent as any other business documents maintained in printed form.
All rights not expressly granted in this Agreement are reserved by Great Solar Deals.
